Welcome to UsedBooths (hereinafter “Seller”). By accessing or using our website and services, you agree to be bound by the following Terms and Conditions (“Terms”). These Terms govern all sales of goods and services by the Seller, regardless of any other terms or conditions you may provide.
General Terms
All sales of goods and services by the Seller are expressly conditioned on the Buyer’s acceptance of these Terms. Any order submitted by the Buyer constitutes agreement to these Terms. Seller’s acceptance of any order does not constitute acceptance of any additional or different terms proposed by the Buyer.
These Terms supersede any verbal communications, other policies, or contradictory terms appearing on the Seller’s website or elsewhere. Unless otherwise agreed in a separate written agreement signed by the Seller, all purchases are deemed to constitute acceptance of these Terms.
Pricing and Payment
Prices are subject to change without notice. Seller reserves the right to correct any pricing errors. All prices are exclusive of applicable federal, state, local, or other taxes or duties, which are the responsibility of the Buyer. Payments must be made according to the terms agreed at the time of purchase. Prepaid orders are non-refundable. Seller may defer shipment of any future orders or cancel unshipped portions of an order if payment is not received as agreed. Seller reserves the right to refuse orders based on payment terms, financial responsibility, or other business reasons.
Refused, Cancelled, or Returned Orders
Buyer has 10 business days to confirm receipt of an order and to report any missing or damaged items via email. Seller will make reasonable efforts to replace missing or damaged parts/items. Any refused, cancelled, or returned orders are subject to a 50% restocking fee, and all shipping costs are non-refundable.
Manufacturer Warranties, Service, and Support
Products returned outside of Seller’s return policy must be addressed directly with the manufacturer. Manufacturer warranties vary by product. Extended warranties may be available directly from select manufacturers. All technical support or service requests should be directed to the manufacturer in accordance with their terms and conditions.
Limitation of Liability
Seller shall not be liable for any failure to perform due to causes beyond reasonable control, including but not limited to: acts of God, acts or omissions by the Buyer or third parties, transportation delays, or inability to obtain labor, materials, or supplies.
Miscellaneous
These Terms constitute the entire agreement between the Buyer and Seller regarding the sale of goods or services. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any disputes arising under these Terms shall be governed by the laws of the state in which the Seller operates.
